The pandemic and health emergency situation in which we are still living has led States (Governments and/or Parliaments) to decree situations of "state of exception" or "emergency" and to take measures restricting the fundamental rights of citizens (freedom, movement, work, education, etc.), posing new challenges to the Law and Constitutional Courts throughout the world. This DIJUS intends to deepen the dialogue on how the protection of health, the prevention of undemocratic excesses and the preservation of fundamental rights constitutionally protected in States governed by the rule of law can and should be reconciled.
